OHADA Uniform Act of Arbitration

The Uniform Act on Arbitration (the Uniform Act) governs any arbitration taking place in an OHADA member state, whether the arbitration involves parties from an OHADA country or from a foreign State. Framed on the UNCITRAL Model Arbitration Law, its purpose is to promote arbitration as an efficient means to settle disputes.

Who can bring an arbitration under the Uniform Act?

The Uniform Act on Arbitration (the Uniform Act) does not limit arbitration to commercial and professional matters; individuals and corporate bodies alike may refer their dispute to arbitration.

What arbitration bodies are under OHADA jurisdiction?

The Uniform Act unifies and supersedes the national laws on arbitration of member states.

  • Benin
    The Arbitration Centre CAMEC (Centre d’arbitrage de médiation et de conciliation) attached to Benin’s Chamber of Commerce and Industry is based in Cotonou. Another arbitration body is the Chambre de conciliation et d’arbitrage de l’Association interprofessionnelle du coton, also in Cotonou.

    The Ouagadougou Arbitration Centre (CAMC–O) (Centre d’Arbitrage, de Médiation et de Conciliation de Ouagadougou) attached to Burkina Faso’s Chamber of Commerce, Industry and Artisans is based in Ouagadougou.
  • Cameroon
    The GICAM Arbitration Centre (Centre d’arbitrage du Groupement interpatronal du Cameroun) is based in Douala.
  • Côte d’Ivoire (Ivory Coast)
    The Arbitration Centre (Chambre d’arbitrage de Côte d’Ivoire) is based in Abidjan.
  • Guinea
    The Arbitration Centre CAG (Chambre d’Arbitrage de la Guinée) is based in Conakry.
  • Mali
    The Arbitration Centre CECAM-CCIM (Centre de conciliation et d’arbitrage du Mali) is based in Bamako.
  • Senegal
    The Arbitration Centre (Centre d’arbitrage) attached to Senegal’s Chamber of Commerce, Industry and Agriculture is based in Dakar.
  • Togo
    The Arbitration Court CATO (Cour d’arbitrage) attached to Togo’s Chamber of Commerce, Agriculture and Industry is based in Lomé.
